Terms & Conditions

The following general terms and conditions regulate the contractual relationship between KUVARA Jewellery and the consumers and entrepreneurs who buy goods via our store KUVARA Jewellery. Contradictory conditions or conditions deviating from our terms and conditions will not be accepted by us. The contract language is English.

Conclusion of contract

The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order.

By clicking the buy button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

Retention of title

The object of purchase remains our property until full payment.

Legal liability for defects

Warranty towards consumers for used goods.

Your warranty claims for defects in used goods shall become statute-barred one year after the goods sold have been handed over to you. Excluded from this provision are claims for damages, claims due to defects that we fraudulently concealed, and claims arising from a guarantee that we have assumed for the quality of the goods. The statutory limitation periods shall apply to these excluded claims.

Limitation of liability

We exclude liability for slightly negligent breaches of duty insofar as these do not relate to material contractual obligations, damage arising from injury to life, limb or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. The essential contractual obligations include in particular the obligation to hand over the item to you and to provide you with ownership of it. Furthermore, we must provide you with the item free of material defects and defects of title.

Amendment and validity of the GTC

These general terms and conditions are valid even without signature. They can be changed by KUVARA Jewellery at any time. At the time of the conclusion of the contract, the respective GTC published on KUVARA Jewellery are valid.

Delivery and shipping areas

General prices and shipping costs

For orders via the online store of KUVARA Jewellery, the prices listed in the offer at the time of the order are valid. All prices shown are CHF amounts exclusive of postage and shipping costs and customs duties. The postage and shipping costs will be added to the sales price.

The prices published by KUVARA Jewellery and all information about the goods, which the customer receives during the order process, are non-binding. In particular, errors in description, illustration and pricing are reserved. KUVARA Jewellery reserves the right to change prices, offers and articles.

Please note: For international deliveries outside of Switzerland, additional costs such as customs duties and possible handling fees may apply. These will be claimed directly from the responsible customs office. KUVARA Jewellery is not responsible for any customs duties and possible handling fees for international deliveries.

The delivery time of international postal shipments depends on the recipient country and the shipping method (airmail/landmail/shipping method). KUVARA Jewellery is not liable for delays of the shipping company.

Shipping costs will be added to the sales price and shown separately on the order. They are calculated based on the destination country, the shipment weight and volume of your order.

For international shipments we only ship with tracking.

National deliveries (within Switzerland)

KUVARA Jewellery will ship your order within 7 to 14 days by Swiss Post, unless otherwise stated. If KUVARA Jewellery cannot meet this deadline, you will be informed immediately. If deadlines are indicated in working days, these are all weekdays with the exception of Saturdays, Sundays and public holidays.

KUVARA Jewellery is not liable for delays of the transport company.

Please inform KUVARA Jewellery immediately about any delays in delivery.

Shipping costs will be added to the sales price and shown separately on the order. They are calculated from the shipment weight and the volume of your order.

If the products sent by KUVARA Jewellery are not accepted or picked up by the customer or cannot be delivered by the Swiss Post, the customer will be charged for all transport costs incurred.

Orders (invoice and payment terms, VAT)

Terms of payment

The valid currency is Swiss Franc (CHF). The valid payment options are the indicated credit cards, Paypal. The payment has to be made in Swiss Francs in any case. KUVARA Jewellery reserves the right to grant other payment options in individual cases. This is to be agreed upon in writing with KUVARA Jewellery before the order.

Returns Exchange and return policy

Cancellation

If you want to withdraw from the contract, you have a right of withdrawal. Please inform KUVARA Jewellery immediately by e-mail or contact form if you want to cancel your order or return the goods you have already received.

If the goods have not been shipped yet, you will be refunded the costs of the goods you do not want to receive, including the delivery costs, if the cancellation refers to the entire order. If you want to cancel only a part of the order, the delivery costs will not be refunded.

If you have already received the goods and you would like to return them, you have to inform KUVARA Jewellery about your cancellation in writing via e-mail within 7 calendar days after receipt of the goods.

The goods must be returned in perfect condition and in the original packaging. If these conditions are met, you will be refunded the amount of the goods in question, including the delivery costs for the return shipment (this does not include the return shipping costs) in the form of a voucher. If these conditions are not met and the returned goods are defective, KUVARA Jewellery reserves the right to credit only a part of the goods in the form of a voucher or to refuse the return of the entire goods.

Please note: The return shipping costs will not be refunded. Also possible customs fees, for which you had to pay in case of an international delivery (outside Switzerland), will not be refunded by KUVARA Jewellery (more about this, see: Return).

Please label the return with your sender and the above address of KUVARA Jewellery.

IMPORTANT: Returns from abroad must be clearly declared as a return at the customs declaration. If the declaration is not made correctly, additional import charges will be incurred for the return to Switzerland, which will be deducted from your credit in the form of a voucher.

Warranty Warranty conditions

Repair

Please take pictures of externally visible damages on the delivered packages/products immediately upon receipt of the goods and report them immediately to KUVARA Jewellery. In case of justified defects, you will receive a replacement delivery or the repair of the goods at no further cost to you (returns will only be accepted in original packaging). If the repair fails or if the replaced goods are also defective, you have the right to a price reduction or you can send the goods back to us for a refund of the total purchase price. KUVARA Jewellery does not assume any warranty for damages and defects resulting from negligent or faulty care or improper repair. KUVARA Jewellery will endeavor to find a quick and satisfactory solution for all parties concerned.

Applicable law and place of jurisdiction

Place of jurisdiction

If, despite all efforts, we are unable to reach an agreement, Swiss law shall apply.

The place of jurisdiction shall be Bern, Switzerland, subject to any other mandatory jurisdiction of the court.
